Elder Law (average age of client is 70-100)
Woodford Law specializes in providing assistance to seniors who are advanced in age and may be receiving care at home or at a nursing home. This most often includes “crisis planning” for those who are already in need of care but have not made preparations to protect their assets through estate planning. Through its subsidiary Woodford Medicaid, Woodford Law has helped over 1,000 seniors living in nursing homes through application to qualify for Medicaid benefits. Through various vehicles such as Medicaid Pooled Trusts and single premium immediate annuity contracts, Woodford Law can greatly reduce costs to your or your loved ones’ estate.
Estate planning is critical to asset protection. By spending a few moments with Woodford Law to set up your estate, you can enjoy numerous benefits including the peace of mind that your loved ones are well protected under any circumstances. Estate planning should occur in two phases during your life:
Phase I - (average age of client: 25-55) – Woodford Law recommends that clients undergo estate planning when they first own property with another individual, get married, or have a child. At this time, it is important to set up health care proxies, power-of-attorney’s will, and a revocable trust.
Phase II – (average age of client: 55-75) – Woodford Law recommends that seniors undergo a review of their existing estate planning and establish irrevocable trusts to protect their assets well ahead of the five year lookback. Contact Woodford Law for details.
Real Estate Law
Whether you are individual buyer, seller, or investor, Woodford Law P.C. offers legal representation for all of your real estate-related needs. For many individuals, buying or selling a home is the single largest investment decision they will make. At Woodford Law P.C., we understand the emotional and financial impact of this decision. Through sound counsel and tireless due diligence, we offer the peace of mind and assurance you need to confidently move forward with your transaction.
Woodford Law P.C. has an affiliation with Silverstone Real Estate to whom it refers all clients seeking brokerage services. Silverstone Real Estate is a full-service real estate brokerage company owned by Steve DeFrancesco and Jim Stone and has dutifully served clients in the South Shore for over 10 years.
Woodford Law handles two types of cases in probate court:
Probate of a Will – When someone passes away with an asset owned in their name alone, Woodford Law can “probate” the will. Upon acceptance of the will by probate, a decree will be ordered to the Personal Representative (also known as an “Executor”) which allows access to the asset, permitting distribution pursuant to the terms of the will.
Establish Guardianship/Conservatorship – When individuals fail to establish power-of-attorney and health care proxy and later become mentally unable to execute documents, Woodford Law can assist with petitioning the court to appoint a guardian or conservator.
While Woodford Law is well equipped to assist with probate court cases, we recommend taking steps early to avoid this process. Contact Woodford Law today to proactively establish properly drafted trusts, power-of-attorney, and health care proxy in order to avoid the often costly probate court process. See the Estate Planning section for more details.
LLC & Corporate Law
Many sole proprietors, partners, and small businesses act as their own employer, operating without the shield of an LLC or corporation. This exposes the owners of these businesses to unnecessary levels of risk including exposing their personal home and assets to litigation. Whether you operate a small part-time business out of your home or you run a full-time business with several employees, incorporating your company is a simple and straightforward process which can offer significant benefits. Woodford Law can assist with establishing the appropriate protections for your business today. Contact us for a consultation to determine if establishing an LLC or corporation is right for your business.
